The relationship between censorship and student publications Essay Pushing the limits of free speech and then killing it is not an uncommon theme for todays student press. Civil disobedience and censorship of student publications has been a hot-button issue since the 1960s and remains a crucial, yet under-examined area of free speech. In an assumed tolerant democracy which flaunts philosophical ideals like a free market of ideas, censorship laws have undermined the essential function of student newspapers as an outlet for challenging, insightful and investigative journalism. The following essay seeks to examine the relationship between censorship and student publications by specifically drawing on the Rabelais case. Accordingly, this essay further attempts to explore the legal and philosophical reasoning behind censoring student newspapers. In 1998, the Full Court of the Federal Court handed down its first decision which directly involved the right to political communication of a student publication1. The court held that an article advocating theft published in the La Trobe University student publication, Rabelais, instructed in matters of crime and was not protected by the implied constitutional freedom of speech.2 The appellants four editors of the publication argued that the article addressed issues of wealth distribution in a capitalist society and constituted political communication.3 Prior to Rabelais, Australian courts have never squarely confronted political communication in relation to the National Classification Code.4 Whilst the Federal Courts decision to uphold the findings of the Classification Review Board generated another proponent of control on the boundaries of political communication, it simultaneously limited the journalistic scope of student publications in challenging the moral and political patterns of society. The implications of Rabelais have since posed an explicit threat to the autonomy of student publications by which student journalists are left confined within the legally permissible censorship system.5 A common principle validating restrictions on free speech is balancing. In the case of Rabelais and similar articles in nature published in other student publications, striking a reasonable balance between political material and Australias censorship laws fosters the argument that the protection of political communication is not absolute. Judicially-considered concepts underpinning political communication6 is often subject to the maintenance and protection of the system of representative government.7 By strict adherence to this generalization, virtually all political dissent and civil disobedience is then liable to interfere with the maintenance and protection of the government system. Heerey J8 provided further insight, claiming this relationship to accommodate an imbalance in which the protection of representative democracy overrides the protection of dissent9 by student publications: It should be noted that Anarchist theory extended from non-violent writers and political leaders like Tolstoy, Thoreau and Ghandi to Proudhon (property is theft) the Anarcho-Syndicalists whose creed was that unions should become militant organizations dedicated to the destruction of capitalism and the state. All this may be in one sense politics, but the Constitutional freedom of political communication assumes indeed exists to support, foster and protect representative democracy and the rule of law. The advocacy of law breaking falls outside this protection and is antithetical to it. 10 However, the argument brought forward by his Honour is severely flawed. The knowledge needed to draw political comparisons from the works of Tolstoy, Thoreau and Ghandi lies in the mere fact that the writings of these revolutionaries were not refused classification, but available to the public for debate and reflection. In this instance, measuring competing interests on the basis of political ideologies in power would easily translate into banning all commonly dissenting student publications.11 The classic role of student publications in discussing socio-political affairs beyond the bounds of moral and legal civility is one which indeed supports, fosters and protects the system of representative democracy. This lends itself to another critical failure in determining classification of student publications. In refusing classification of Rabelais, the Review Board directly addressed the legal aspect of inciting crime, compromising the publications implied rights to political communication.12 It did so by appraising the article in isolation from other writings of political nature, published in the same edition.13 Setting aside possible constitutional questions, the approach in reviewing student publications does not distinguish between student and mainstream media. If a student press is to function as the dutiful outlet of alternative and challenging thought in society, then such definition should allow for exceptional free speech privileges. To give further reference to the limited interpretation of the role of student publications in Australia, there is a high probability that the article in question would have been permissible to publish in other countries, particularly the United States. Not only does the existence of a U.S. Bill of Rights expressly protect the rights of individuals to free speech, but an implicit rule applied by U.S. courts entitles student journalists to the highest level of First Amendment protection to sustain the traditional libertarian function of student publications. 14 The rule that student publications enjoy freestanding exemptions of restrictions underlying the First Amendment emanates from legislation based in the state of California, which expressly duplicates First Amendment rights to college and university students. 15 One can hardly ignore the advantageous effects of a similar law being implemented in Australia. Like the United States, it is widely maintained that student publications in Australia should remain wide-open free speech zones, where every form of speech is permitted and censorship controls are turned off.16 However, the recent introduction of the Voluntary Student Unionism bill17 before parliament has additionally threatened the agenda of student publications. Although the bill, which traces back to 197418, sets out to render universal student unionism voluntary, it could potentially be the first law that directly undermines students right to free speech by defunding Australias student press19. The Western Australian (WA) VSU model, which came into force in 1997, has cut funds directed to all student publications in the state, while other student advocacy bodies were lost completely.20 In conclusion, although Australia has a robust commitment to freedom of speech, on a practical level, this commitment is too often regulated by prevailing moral and legal protocols. As evidenced by the legal implications brought forward by the Rabelais case, there remains little conscious acknowledgement of the significant function of student media in challenging dominant viewpoints. Given the undoubted importance of the court in interpreting political communication, the process in determining such can only be rendered valid and objective if the historical and philosophical principles underpinning student media are taken into consideration. The burden here is not only on the narrowed definition of political communication, but the lack of an accountable and tolerant classification system. Similarly, the Rabelais case reawakens the time-worn argument of implementing an express free speech right in Australia. Given that student publications are dedicated to political dissent and civil disobedience, and thus vulnerable to legal ramifications, it would arguably seem fair to grant student media the privilege of special free speech rights, over and above all the general speech rights Australians enjoy. A law similar to that of the United States would allow society to recognize the doctrine of academic freedom and protect and maintain the free market of ideas in a representative democracy. Lord of the Flies Imagine having to be flown away from your home because of a war. That is bad enough. But, then imagine your plane crashing on some deserted island on your way there. The pilot of your plane is dead and your stuck with approximately 20 other young boys like yourself. No adults! What are you going to do? This is the scenario in the movie "Lord of the Flies". At first all of the little boys come together and work together to figure out what they are going to do and how they are going to handle things. They are civilized little English school boys in the beginning. They go around and find out what everyone's name is. They get together in a meeting and vote a young boy named Ralph as the leader. Ralph is a quiet and well mannered little boy and he looks out for the best of everyone. Ralph believes in decency and civilization. Ralph has a follower nicknamed Piggy. Piggy is an overweight smart little kid. Ralph makes up rules like only one person talking at once and you have to raise your hands. Things like this that keeps order in the group. Piggy always backs Ralph up on his decisions. Things go well for a while, until they start believing that there is a beast that is on their island and is after them. The civilizations starts to change when Jack, a snotty sarcastic kid, takes a group to hunt for the beast. They start killing pigs and eating the meat. Things start to get out of control and they begin to paint their faces and sharpen spears. So, the group gets divided because more boys start to follow Jack because they have food even though they are crazy. Jack's group accidentally kills Simon, one of the younger boys. Piggy sticks with Ralph the whole time, even when they were the only ones left with some decency. Jack and his friends come and steal Piggy's glasses to start a fire and this makes Ralph mad. Ralph and Piggy go to regain Piggy's glasses and Jack's tribe makes a huge boulder fall on Piggy. They killed him. This leaves Ralph as the last one left. So Jack's tribe hunts him. They chase him all through the jungle and then onto the beach. Ralph stumbl es and falls right onto a man with white pants and bright white shoes.

Hacking and Countermeasures: Controls

Aim Higher College needs to ensure the safety of all its information. Recently we have seen suspicious and careless activity in the research data center. Data center technicians have reported lights left on, doors left open, successful logins to the research database, as well as login attempts in the backup business database after normal hours of operation. Because this is also the backup for our business information we need to keep this area as secure as possible.In order maintain control over who has access to what in the center we need first ensure that only those that need access to the center are granted the appropriate permissions to the areas that they need. The revolving door should only allow one person through at a time, this will help to prevent someone without access from slipping by with some one that does have access or allow a person with access giving access to some that is not authorized in the build. This will be done with a using simple radio frequency identificati on (RFID) cards for the initial access to the building’s lobby.Both entry and exit will require that the card be read so that a log of who enters and leaves the building can be kept. Entry to the staff offices will simply be with a RFID card reader. With these cards, we can select what areas they have access to according to their needs. The front double doors and access to the receiving area can only be opened from the inside of the building. By allowing one-way access we ensure that hacking of the reader is not possible. Biometric scanners should be used for all sensitive areas as a second method to prevent card cloning. Those that have access to sensitive areas or doors that can allow more than one person through such as the shipping area and front double doors will be issued a Personal Identity Verification (PIV) cards. These card work with the biometric scans. When the card is scanned it relays to  the biometric scanner the information that the scanner will need to make the identification.This means that even if the card’s RFID is cloned as soon as it is read it would be denied because the biometric information is not there. The biometric that we should use is an iris scanner. Rather than hand dimensions that can change or fingerprints. Fingerprints are easy to fool, if the finger is dry the scan may not read correctly, the maintenance if high as the sensor must be cleaned, impurities on the hand or air can give false readings, and lastly to prevent the spread of disease. Iris scanners do not require physical contact, eyeglasses, and contracts normally do not disrupt the reading.To make things easier the iris scanning is much faster. The iris can be scanned as the person is walking up and then compared to the card when the PIV is read . In addition, it is my recommendation that the datacenter be physically separated between the backup site and the research site. This will allow students and staff to gain access to the research center but no t the backup center. Only those that need to have access to the business side backup will be required to use biometrics and a PIV card. All servers will be locked in cabinets for the protection of the severs and SANs that are on site.This will deter theft of any equipment that might contain information. Security cameras will be used to monitor all access and movement within the building. Thirteen stationary static cameras will need to be in use to watch all hallways, doors, and the datacenters. Two motion detecting pan / tilt / zoom (PTZ) cameras will be paced in the center of the data centers (one in each) to follow and watch the activity of persons entering. This should be accompanied with a security system that monitors movement, doors and windows. The diagrams below show the position of the cameras and access control equipment and measures that are recommended.In the event of a power outage, it is highly recommended there is enough UPS in place for at least 15 minutes to allow f or proper shut down. Preferable would be to have a backup generator so that information can be saved and moved to another site or to maintain functionality until the power comes back on. Protection of the systems will consist of the floor being raised by at least eight inches from the ground and an automatic pump system in place to mitigate flooding. Because there are people working in these areas  we need to ensure that we have an adequate fire suppression and we need to keep in mind the equipment that is in the room.The recommendation here is to use an waterless fire suppression. While it may not be as cheap as using water, the damage of having a water system in the area will be much more expensive. Waterless systems work by lowering the oxygen in the area to a point that the fire cannot continue combustion without the harmful effects to persons like Halon or CO2. The have been proven to put out fires faster without any damage people. This will give all persons enough time to ev acuate calmly in case of fire . Water systems only help in containing the fire until fire fighters can arrive, in the meantime, we are causing damage to our own equipment They cost of the damage would be in the millions to replace servers and other equipment.The estimated time after a fire with a water system is approximately one month if data can be recovered. Not that we have the physical aspect of the data centered covered we need to look at the technical or logical side of protecting the information. Safeguarding the confidentiality, integrity, accessibility, and the non-repudiation (CIA) is vital. As stated before an IDS and IPS will be put in to place to watch the system at all times to report and mitigate if not stop unauthorized activity to the business backup and research databases. This will help with monitoring the network and see what and where unauthorized traffic and attempts are coming from. Anti-virus and anti-malware programs will be installed on all systems in both databases to protect the information and programs.Firewall implementation between the networks is necessary to keep unauthorized attempts from getting in to the business side of the database. All information will be encrypted so that if the data is or any hardware is stolen then the information be more difficult to read and will hopefully discourage the thief. To prevent a brute force attack through a console connection after 3 attempts at a password the system will lock down that port and a flag will be sent to the data center technician on duty.To ensure that the person that is attempting to gain access to the server through a console connection a token that generates a random alphanumeric code will be used. As we all know people are where we see the biggest problems in security breaches and problems on any computer or network system. People need to understand what they are allowed and not allowed to do, this is where policies, procedures, and training come in to play. By  impl ementing policies that use best practices, such as an acceptable use policy for all staff and students, we make it known what they are allowed to do, and what the consequences are should they choose to ignore the rules.Training all staff and students on security awareness is something that is necessary so that people to go or do things that can jeopardize the network. Making sure that procedures are documented help if there is a problem that can arise again, this reduces down time should the problem return. Making sure that a disaster recovery plan (DRP) is in place, practiced and trained on regularly. This is critical to make sure that down time is as minimal as possible. The separation of duties helps to break up the processes involved to complete a task prevents one individual from having total control over the whole system.Each person or team is responsible for his or her area only and if required forces collusion so that someone else is needed to meet the end goal. It acts like a checks and balance. With these policies in place we need to ensure that they stay current with or business continuity plan and the goal of our mission statement. This will be accomplished by security reviews and audits. This helps to ensure we do not get complacent as well. Performance evaluations help with ensuring that all staff is at their peak performance. Here is where performance correction for both junior and senior members comes in to play. We always need to keep even our staff up to date and fine-tuned to keep one-step ahead. Background checks from time to time are a good way of making she that all employees are acting honestly.There by safeguarding from any circumstance outside of work, that would lead one to perform maliciously with in work for a personal gain. Required vacations will help with employees with being overwrought with situations at work. As people, we need to step back, rest, and regain focus. Forcing staff to take vacations helps this happen. Finally, ro tation of duties helps to make the team come to a better understanding of the network as a whole. This allows all members to be cross platform trained, which helps when someone is sick, on required vacation, or a team is short from termination. Aim higher college has come a long way in the two months now that security is serious concern.If we work together then we can make this college one that students and faculty feel safe coming to, to learn and teach. With colleges competing with online schools and courses, our information system needs to be at its most secure and best  performance to keep pulling students in. These controls are just an insight as to the recommendations that looked at seriously and deeply considered to make sure that Aim Higher College stays at the top.

Core beliefs of Buddhism: Buddhism, as a religion, lays great emphasis on the adherence to the basic beliefs. Buddhism, like most of the great religions of the world, is divided into a number of different traditions. However, most traditions share a common set of fundamental beliefs. The basic Buddhist belief comprise of the basic teachings and concepts of Buddhism. Lord Buddha urged His followers to concentrate on the Four Noble Truths, which helps in attaining freedom from suffering. In the following lines, we have provided more information on the basic Buddhism beliefs: The Four Noble Truths: The Buddha's Four Noble Truths explore human suffering. They may be described (somewhat simplistically) as: Dukkha: Suffering exists: (Suffering is real and almost universal. Suffering has many causes: loss, sickness, pain, failure, the impermanence of pleasure. ) Samudaya: There is a cause for suffering. (It is the desire to have and control things. It can take many forms: craving of sensual pleasures; the desire for fame; the desire to avoid unpleasant sensations, like fear, anger or jealousy. ) Nirodha: There is an end to suffering. Suffering ceases with the final liberation of Nirvana (a. k. a. Nibbana). The mind experiences complete freedom, liberation and non-attachment. It lets go of any desire or craving. ) Magga: In order to end suffering, you must follow the Eightfold Path. Another fundamental belief of Buddhism is often referred to as reincarnation — the concept that people are reborn after dying. In fact, most individuals go through many cycles of birth, living, de ath and rebirth. A practicing Buddhist differentiates between the concepts of rebirth and reincarnation. In reincarnation, the individual may recur repeatedly. In rebirth, a person does not necessarily return to Earth as the same entity ever again. He compares it to a leaf growing on a tree. When the withering leaf falls off, a new leaf will eventually replace it. It is similar to the old leaf, but it is not identical to the original leaf. After many such cycles, if a person releases their attachment to desire and the self, they can attain Nirvana. This is a state of liberation and freedom from suffering.

Magdas has had her leg amputated due to gangrene, which causes mobility difficulties. Her poor sight due to diabetes adds on to mobility needs. The aim is to prevent disability where Disability is defined under the DDA1995 as physical or mental impairment which has a substantial and long term adverse effect on a persons ability to carry out normal day to day activities(Mandelstam 2005) p 490. Magda is already known to the mental health services; however she appears to being violent to Jan. It is important for Magda to have a specialist mental health assessment. Ulasand Connor (2000) Through the mental health route, Magda may be eligible for services through the Mental Health Act 2007 which has introduced the supervised treatment in the community. This Act modifies the 1983 Act and amends the 2005 Act. If Magda lacks capacity a named person can make a decision on Magdas best interests under the Mental Capacity Act 1 (5). Under this acts the social worker would be able to promote healthy, safety and personal wellbeing of both Magda and Jan. It may be suggested that in situation where risk is low Magda may also be entitled under section 29 of the National Assistance Act 1948 to a mandatory grant for essential adaptations that will enable her to move around her home more easily Brayne, et al (2001). Examples of the type of adaptations that may be carried out are: Installing a stair lift, providing a toilet and shower downstairs, installing a ramp. Bornat, J. (1994). Magda may get funding for adaptations through Housing Grants, Construction and Regeneration Act (1996), disabled facilities. Magdas diabetes and schizophrenia and amputation places a duty on the local council to assess needs provide services through the Chronically Sick and Disabled Persons Act (1970). Under this act, the Local Authority has a duty to assist a service user with practical help in and around the home. This includes the personal care, transport services and meal facilities for the service user, sharky (2000). A home carer may be arranged for Magda under section 2 of the CSDPA 1970 to provide personal care, such as assistance with bathing and dressing, help with getting in and out of bed, and help with medicines. It also includes practical assistance in the home to improve safety, comfort, and convenience and manage with daily tasks more easily and independently as suggested in Maczka, K .(1990). The 1968 HSPHA (section 45 DHSS Circular 19/71) instructs the Social Services to cater for the delivery of hot meals to Magda at her home by a meals-on-wheels service. However a charge is usually made for each meal. Section 21 Sch. 8 of the 1977 National Health Service Act provides a laundry service for people who are incontinent or who for some reason cannot do their own laundry in line with Vernon, S. ( 1997). If the risk is high for Magda to live in her house and does not want to go into residential homes, supported housing may be an option. The National Assistance Act 1948 Sec 20 facilitates provision of appropriate accommodation. This Act may be used if Magda is voluntarily moving, however her condition should satisfy two requirements and one should be medical. Supported housing offers a wide range of support tailored needs. Service users in supported housing can live as independent and as private. There is an option of companionship from staff if one needs it. Most services offered in Magdas home are available if she chooses to go in supported housing in Heywood et al. (2002). It is probably possible that, after the assessment Magda had been seen as unfit to live in the community even with support, and has to go to residential home against her wishes. The National Assistance Act gives compulsory powers to put Magda in a care home. This decision may be made in her best interest of Magda. The General Social Care Council codes of practice that call for attention towards empowerment and choice. The guidelines are aimed at employers and employees to maintain to a reasonable standard of practice within the social work field. The General Social Care Council, codes of practice expects social care workers to, Supporting service users rights to control their lives and make informed choices about the services they receive; (G.S.C.C. 2002 p1). The other issue is that the couple are experiencing financial issues; Jan is accumulating debt in the local shop. There is need to investigate the reason why Jan is accumulating debt. There is need explore whether the accumulation of debt is not due to alcohol, drug abuse and or gambling. There is a possibility of Jan being vulnerable and experiencing financial abuse from a member(s) of the community. In order to get the true picture of what is taking place, it is important to discuss the debt problems with Jan. It is equally important to check if Jan and Magda are getting all the benefits that they are entitled to. The assessment of peoples needs is a local authoritys responsibility part of the section 47, NHSCCA 1990. The assessment of needs guides whether service provision by community care is required. Needs led assessments are being highlighted in order to move away from resource led assessments. This act allows professionals to fit a person into an existing service rather than getting the service to fit the persons needs. Limited resource eliminates availability of choice. An example would be, a home carer being sent to an elderly person home to provide caring duties. Due to lack of resource and money the carer has to provide home care at an early time of 7pm. This is considered too early for the client who wishes to go to bed after 8pm. But as there may be no other services the client could settle for what is provided, this is a violation of the clients choice. These issues can be magnified as forms of discrimination and oppression. The principles of consumerism underpin many of the objec tives from community care provisions, this is what is in line to Thompson (2003): Station 1998. The Carers (Recognition and Services) Act 1995 and the Community Care (Direct Payments) Act 1996 established statutory intervention in the caring field. Direct Payment scheme does allow users to obtain cash instead of services from local authority. Direct Payment scheme promotes a caring service, which revolves around contracts and employment law, Crawford and Walker (2006). Personalisation of service promotes independence, enabling individuals to have a greater choice and gives clients the responsibility for meeting their housing related support needs The local authority still has an overall say, local authority has discretion over whether to offer someone direct payments and can decide whether they are appropriate and whether the disabled person can manage them (DOH 1998a in Sharkey, 2000). The White paper Caring for people (DOH, 1989), aims hope to enable people to live a normal life as much as possible in their own homes or in a homely environment in the community. It also states that the right amount of care and support should be provided to help people achieve independence by maintaining basic living skills to achieve daily living activities. The main aim, which highlights empowerment, is the prevention of gate keeping allowing individuals to have a greater say towards how they live their lives and the service provision. Kemshall and Littlechild (2000). Ungerson and Kember further state how feminist research looks at the significance of women in informal care and the effect this has in differences between male and female participation in the labour market. Feminists such as Mc Laughlin and Glendinning (1994), Lewis (1992), Ungerson and Kember (1997) etc. have recognised that gender relations in the welfare state are not as simple as mainstream theorists such as Esping-Anderson would have us believe. On the same line, the other feminists such as Barnes (1997) have also looked into gender differences in the welfare state by studying informal care, and the gendered imbalances surrounding it. Barnes claims that women have the main responsibility for informal care. (1997:13). It can be assumed that many policies of the welfare state are at the present, not geared towards Mclaughlin and Glendinnings de-feminisation. According to Henwood 1998, 1in 8 persons is an informal carer to either a relative or a family member, which has led this group of people to become more recognised for the support they give to clients. Supporting carers not surprisingly has proved increasingly popular with the government, because it helps to reduce the demand of local authority funded service, reasserting the responsibility onto families and individuals. However as straightforward as this may seem, the government cuts has added to the difficult task of translating the support into actual rights and benefits in my view. Finch and Groves (1977) argue that policies for community care were, within a context of public expenditure cuts, and were fundamentally incompatible with policies for equal opportunities for women. They claimed that in practice community care equals care by the family, and in practice care by the family equals care by women. (Ungerson, 1987: 494) Because of feminist contributions and increased knowledge of community care the Equal Opportunities Commission commissioned a study of carers and for the first time a serious effort had been made to plot the incidence of caring and to discover the sex ratio. The results found, Out of the 116 carers, 87 (75%) were women and 29 (25%) were men. (Equal Opportunities Commission, 1982b, 3) The Equal Opportunities Commission then published a set of recommendations for the support of carers, in terms of services, financial benefits and employment rights, (The Equal Opportunities Commission). The carers visible to government statistics are married men aged less than 64 years old caring for their disabled wives and single people caring for infirm parents. Carers are only visible to policy makers when they receive some kind of state benefit, yet many welfare benefits exclude married womenà ¢Ã¢â€š ¬Ã‚ ¦.(Equal Opportunities Commission, 1982b: 3) Further to this councils have adopted a top down model in which local disability organisations are not closely enough involved within. Social workers need to work in partnership with service users and not make assumptions about what they feel is the best for them, even if it appears obvious and the wishes of the service user must be respected. It requires skill and professional judgement on behalf of the social worker to balance the wishes of the adult with the need to protect them. There are no specific laws relating primarily to old people like there is for children under the Children Act 1989 therefore social workers must draw on legislation from different areas in order to provide the best outcome. The training and specialist knowledge the social worker has, the more positive the outcome is likely to be. Also the available resources within the local authority have a significant impact on the care and support that an old person receive and varies widely in different regions. This lack of resources inhibits the proper application of the law, Crawford and Walker (2006). As a social worker it is important to be aware that people are different and where there is difference there is the potential of unfair discrimination. Stanton, (1998). Anti-discriminatory practice is a complex area with many and diverse dimensions such as disability, race, gender, age and sexuality. Much of the discrimination inherent in social work can be seen to be unintentional, due to lack of awareness rather than deliberate attempts to oppress. Thompson (2001). It is important to intervene in a non-discriminatory and non oppressive manner when working with older people. Thompson, (2001) p 88, explained that social work with older people has a considerable discriminatory potential. Society has a tendency of marginalising issues relating particularly to problems of old age. This behaviour can be referred as ageism, and ageism behaviour is in itself discriminatory. Hughes and Mtezuka (1992) describe ageism as the social process through which negative of and attitudes towards older people based solely on the characteristic of old age itself, resulting in discrimination. There is a lot of reference to empowerment and choice in social work settings when in actual fact, one wonders if this is fully promoted. Given that the majority of disabled people are on low incomes or are reliant on welfare payments, their choice is effectively limited to services chosen for them by the local authority social services department. Barnes et al (1999) cited in Kemshall and Littlechild (2000) p 218 On the same subject, Hugman (1998) cited in Kemshall , stresses that these services are made possible through the tax payers money and the same people paying into the taxes are the professionals that control the budgets which poses are a question to the idea of choice made by the consumer. The government cost cutting scheme has negatively affected welfare services, making reference to empowerment and choice meaningless. The power I hold as a social worker, could be used constructively as a useful tool for empowering this family in order to take steps to combat the imbalances that exist between us, and, if used appropriately can enhance their lives, whereas abuse of this power would reinforce the power imbalance and oppression. These power issues can be used to inform my practice and as Stein (1976) in Williams, F. (1989:172) suggests, the relationship between races, social classes and between helping professionals and their clients are all variations of unequal power relations in society. The power imbalance between white social workers supporting ethnic minority clients, places the professional on a privileged position, this may contribute to discrimination and oppression. Thompson (2003). It is possible then to address these imbalances of power, discrimination and oppression? By developing an understanding of the concept of race and cultural differences and identities and oppression. Race and oppression cannot be fully understood without also understanding the notion of power and as Thompson distinguishes the social worker may not be sufficiently sensitive to issues of power/powerlessness and oppression. The Distinguishing between Hester and Dimmesdale in Nathaniel :: essays research papers

  Ã‚  Ã‚  Ã‚  Ã‚  Both Hester and Dimmesdale, are characters in the Scarlet Letter. They suffer with the guilt of the sin of adultery that they committed. At the time, the Puritans looked down on this type of sin. Hester and Dimmesdale can be compared and contrast in the way they handled their scarlet letter, their cowardliness, and their belief of what the afterlife is. Hester and Dimmesdale both bear a scarlet letter but the way they handle it is different. Hester’s scarlet letter is a piece of clothing, the â€Å"SCARLET LETTER, so fantastically embroidered and illuminated upon her bosom† (Hawthorn 51). Dimmesdale on the other hand, has a scarlet letter carved in his chest. This is revealed when Dimmesdale was giving his revelation, in which â€Å"he tore away the ministerial band from before his breast. It was revealed!† (Hawthorn 232). Since the Scarlet Letter on Hester is visible to the public, she was criticized and looked down on. â€Å"This women has brought same upon us all, and ought to die† (Hawthorn 49) is said by a female in the market place talking about Hester. She becomes a stronger person through living this hard life. Dimmesdale instead has to live â€Å"a life of cowardly and selfish meanness, that added tenfold disgrace and ignominy to his original crime† (Loring 185). He becomes weaker and weak er by time, â€Å"neither growing wiser nor stronger, but, day after day, paler and paler, more and more abject† (Loring 186). Their courage is also weak.   Ã‚  Ã‚  Ã‚  Ã‚  The courage that those two share is quite similar, in that they have none. They both are afraid of the public and what the public would think of them. Hester refuses to tell anyone about her real husband, Chillingworth, who is still alive, or about her lover, Dimmesdale. Hester and Dimmesdale also try to take the cowardly way out when she has a chance to go to leave Boston and go to Europe, â€Å"Her advising them to flee Boston was irresponsible† (Granger 7). Hester after talking about leaving, and while in the forest with Dimmesdale and Pearl, takes the scarlet letter off. She was planning to never wear the scarlet letter again, especially after saying, â€Å"The mid-ocean shall take it from my hand, and swallow it up forever!† (Hawthorne 193). This shows that she did not have enough courage to bear the scarlet letter in Europe. Pearl still makes her bear the letter by saying, â€Å"Come thou and take it up!† (Hawthorne 193).

Back to School Speech by Obama Essay

This essay is about President Barack Obama’s speech â€Å" Back to school â€Å" which he held September 8th 2009 at the Wakefield High School in Arlington, Virginia. The overall message in the speech is whether young people are taking school serious and understand the importance of hard work. Not only for themselves but also for the future of the country. â€Å"Hello everyone – how’s everybody doing today? I’m here with students at Wakefield High School in Arlington, Virginia.† I know that for many of you, today is the first day of school. And for those of you in kindergarten, or starting middle or high school, it’s your first day in a new school, so it’s understandable if you’re a little nervous.† Obama is starting out by addressing his audience like a father figure, trying to reach all realities in the audience by mentioning all the grades. He is making himself real to the audience, presenting himself as a guy who is down to earth. â€Å"Some of you are probably wishing it were still summer, and you could’ve stayed in bed just a little longer this morning† And already in line 10 â€Å"I know that feeling†. He is referring to his own life. He is explaining how he had to get up 4.30 every morning to study with his mom, and how he wasn’t too happy getting up that early. Here he is making himself real to the audience, explaining something from his childhood that they will understand. So here he is using pathos appealing to the feelings. From line 20, it’s like he is changing from being the friend of the audience to his role as the president of the United States again.â€Å" But I’m here today because I have something important to discuss with you.† From line 25, 30 and 35 he is revealing the essence of his speech. His message is that it is ones own commitment and hard work that will make one succeed in life. â€Å"You can have the most dedicated teachers and supportive parents, but unless you individually takes responsibility nothing of this is very helpful.† In line 40 and 50 he is more friendly againâ€Å" Every single one of you has something you’re good at. Every single one of you has something to offer. † He is motivating the audience by saying that every person has something that they’re good at, that everyone has a important role In the American society. Obama is also very good at mentioning things many people can relate to in his speech. â€Å"Maybe even good enough to come up with the next iPhone. â€Å" Here he is mentioning the iphone that most children can relate to. From line 50 to 75 he talks more about morals again. He is very seriously talking about how everyone needs to have an education to get a job, and how it takes hard work. More important in Obama’s speech is that your education not only decides ones own future, but ones country’s future. Obama is really good to alternate between being judgmental and understanding through the speech, for example in the line â€Å" Every single one of you has something you’re good at. Every single one of you has something to offer.† He is very understanding and encouraging to the people, before he with this sentences; â€Å" If you don’t do that – if you quit on school – you’re not just quitting on yourself, you’re quitting on your country. Is being very judgmental. From line 75 to 85 Obama is again being more understanding. Obama explains his personal difficulties from his own childhood, and that he understands school isn’t always easy. Obama explains how his father left the family when he was 2 years old, and that he was raised by a single mother without much money. â€Å"There were times when I missed having a father in my life. There were times when I was lonely and felt like I didn’t fit in.† Obama then talks about how he through hard work was fortunate to go to college and follow his dream, to attempt law school. In this part of the speech Obama is using ethos. He is trying to be trustworthy. From line 95 Obama again set himself up as the country father. He explains that there is no excuse for having a bad attitude and also no excuse for not trying hard and giving your best towards education. From line 100â€Å" Where you are right now doesn’t have to determine where you’ll end up. No one’s written your destiny for you.† Obama is referring to the American dream. Mentioning personal freedom and responsibility for ones own destiny. He explains that with hard work you can accomplish everything you want, no matter background or social rank. From the line 105 – 110 – 115 Obama is stressing his statement by giving some concrete examples about how real people with all sorts of difficulties, made it through hard work and determination. This is an example of logos, because he is giving concrete examples that are supportive to the message of the speech. From line 170 he is again referring to the American dream. â€Å"The story of America isn’t about people who quit when things got tough. It’s about people who kept going, who tried harder, who loved their country too much to do anything less than their best. â€Å" At the end of the speech from line 175 to 185 Obama is talking about America as a culture surviving through many decades.â€Å" It’s the story of students who sat where you sit 250 years ago, and went on to wage a revolution and found this nation â€Å" Obama ask the audiences what they will do to pass on the American culture, and what people in about 50 years will remember from this time. And so he puts some positive pressure on the kids, hoping to get them to understand their responsibility to secure the American dream and culture in the future.

The law was broken when the group of anesthesiologists banded together to drive out any form of competition, which resulted in the failure of Mr†¦ Alto's business. Initially the organization of anesthesiologist from SST. Peters Community Hospital agreed to a settlement of $462,500. The trial Judge deemed the award from the Jury was excessive and ordered a new trial. The conclusions of the new trial were, the damages incurred were not the hospital's responsibility due to lack of evidence and the settlement from the physicians was sufficient (Bazaar 2012).Exclusive Contracts Hospitals routinely enter Into contracts with various professional groups for the sight to be the exclusive provider of their specific services at the facility In exchange for the group agreeing to provide and manage all aspects of that service wealth the hospital. These â€Å"exclusive contracts† generally result In the chosen medical department and associated equipment being closed off to physicians w ho are not part of the contracting group. Exclusive contracts are generally considered to be good for most doctors who participate in the groups and bad for those excluded by them.In fact, while exclusive contracts offer obvious benefits to the physicians who receive he perks from the contracts and obvious disadvantages for those who are excluded, they also present pitfalls for physicians in the chosen group. The included doctors are somewhat slaves to the groups and will be kicked out of the groups if the physician does not comply with the rules and regulations of the contract. Exclusive contracts are agreements that initially appear to be anta-competitive on face value; multiple courts have rejected anti-trust challenges to exclusive contracts creating an unfair advantage, which reduces competition.Physicians and nurses that have been excluded because of exclusive contracts have had much greater success in attacking exclusive contracting arrangements on the premise of breach of co ntract and lack of procedural process grounds. In order to prove there has been a violation of anti-trust and elimination of competition within a work environment such as a hospital. Typically exclusive contracts are built to keep outside providers from competing with the physicians who are already employed at the hospital or medical treatment facility. In rare cases like the Alto v.SST Pewter's Community Hospital case, the nurse anesthetist was already contracted with the facility and performed similar procedures as the anesthesiologists except for a cheaper rate (Bazaar 2012). The hospital administration should have analyzed the formation of the group odd providers and recognized what the Intentions were. Remedies to Breach Arbitration of breaches In anta-trust laws were frowned upon years ago when anta- trust laws were first set into place. Arbitration is a relatively fast way to arrive upon a being flexible and not as formal as a traditional courthouse.Usually, arbitration can b e scheduled quicker and with less working parts than a trial. In rare instances, if all parties involved come to an agreement, arbitrators can sometimes create rulings that judges are not allowed to decide. In arbitration, both sides present all evidence to an arbitrator in efforts to prove each side's case. The arbitrator reaches a final verdict and decides whom the winners and losers are. An arbitrator does the Job that a traditional Judge or Jury would normally do in court if the matter escalated to that point (Hill 2014).Summary Judgment is another remedy to handling the decision process in the event of a suspected anti-trust law breach. Summary Judgment is a decision entered by a court on behalf of one party that was in disagreement with another party, without the length and expense of a full trial. The idea of the summary judgment process is to remove the need to argue agreed upon facts and to decide without trial one or more causes of action in the complaint. The presenting a nd pleading procedures are extremely technical and complicated. This process is fairly dangerous to the party that the decision is being made against (Hill 2014).Conclusion In this scenario, the groups of anesthesiologists were guilty of violating anti-trust saws with the internal contract that was created to eliminate competition from outside vendors for delivery of care. Anti-trust laws were created top prevent larger companies and organizations from pushing smaller entities out of the ability to fairy compete for business. How might a Jacobean audience see certain events in MACBETH differently to a modern one? Essay

Four hundred years ago in the time of the Jacobeans, beliefs then were very different from what they are today and this had impacts on the way Jacobean audiences interpreted certain events in Shakespeare’s plays. This essay sets out how some events might be interpreted differently in Macbeth. Bad things that happened to people were blamed on the supernatural like curses, witches and ghosts e.t.c. First of all was the whole idea of witches. For everything bad that happened to people, witches were blamed for them. Witches were seen as real people who had magical powers and could do almost anything. In Macbeth the witches appear at the very start of the play and accompanying them was thunder and lightning. The Jacobeans see that type of weather to be a bad omen and meant forces of evil or bad things were coming, whereas nice weather meant good things were going on. Today we see bad weather as being caused by scientific reasons; to do with air pressure for example. It has nothing to do with any events happening in the world. In Act 1 scene 2, the witches go on to create a massive thunderstorm. A Jacobean audience would believe this really happened because they thought witches did actually have the power to do that. Nowadays, a modern audience would see that as simply just made up, because we don’t believe in witches anymore. Adverse weather conditions are caused by natural phenomena not by supernatural evil witches. When Macbeth sees the witches for the first time they say â€Å"Hail Macbeth hail to thee Thane of Glamis,† â€Å"Thane of Cawdor† then â€Å"King hereafter†. The witches are saying he definitely will have those titles, not just might be. A Jacobean audience would see this as the witches predicted the future because people back then believed that they could do that. Today we do not believe in witches and again; it would be seen by a modern audience as the witches guessing what would happen. Next is the Thane of Cawdor’s execution. No-one has been executed in Britain for many years; the death penalty has effectively been abolished. But in Jacobean times, it was regarded as the natural thing to do. Therefore a modern audience would see this execution as very serious and would feel he would not deserve that punishment as much as we did 400 years ago. A Jacobean audience would see that he does need to be executed because betraying the king’s (monarch’s) army was considered a very serious crime because it would be a crime against God as well; as the monarchy was considered to be run directly by God. When Lady Macbeth calls on evil spirits to make her powerful and string-minded to carry out the murder of Duncan she says, â€Å"Unsex me here,† and, â€Å"Make thick my blood.† She actually wants to be changed into a man (on the inside) from a woman and be praying out to spirits somewhere she can do this. A Jacobean audience would believe that this is really happening because they believed in sprits; good or bad, and that if you call for them, they can do what you want. A modern audience however would see this as Lady Macbeth thinking that she has lots of power when really she can’t and she’s got too much energy and feels really powerful when really nothing will happen like that. I.e. she has a big lust for power. Today we don’t believe in spirits and that they never exist. We now would think that she’s just feeling lots of power and wants to get it very badly. But just before Macbeth goes to commit the murder of Duncan, he imagines a dagger leading him to Duncan’s room. He says, â€Å"Is this a dagger which I see before me, the handle toward my hand?† He’s seeing this dagger actually taking him to Duncan’s room meaning the dagger should be used to kill him. Macbeth is really convinced and believes it’s there. Because of that, a Jacobean audience would think the witches have put it there in his head because they told the future earlier on in the play, that Macbeth will become king, and he would have needed to kill Duncan to do it. A modern audience on the other hand would think he’s having a hallucination and he’s just simply imagining it; probably explained by the stress of being about to kill the King. Jacobean’s might not have thought that because they didn’t appreciate people can imagine things deliberately or because of stress or mental illness. They would not understand those things. In addition, Macbeth sees a vision of Banquo’s ghost at a banquet. He says to the other guests, â€Å"Which of you have done this?† Again, like the dagger only he can see it and he believes it really was there. A Jacobean audience would have believed in ghosts and life after death. Macbeth had just unlawfully killed Banquo so a Jacobean audience would see that it would make sense for his ghost to haunt him and only him and appear real. But, a modern audience would see this as Macbeth being so stressed by the murder of Banquo and Duncan that one of his victims comes back to haunt him in his mind. The fact that only Macbeth can see it proves that it’s probably his stress. Jacobean’s believed in the â€Å"Divine right of Kings† meaning that the king’s reign is so because it is what God wanted; it’s God’s will for him/her to be king. Therefore if you kill the monarch (called regicide), it was the worst possible crime anybody could commit at the time. If you did it, you were committing a sin against God and the audience would be so shocked they would be petrified. So when Macbeth murders Duncan, the audience would be petrified with disbelief that that just happened. Today, we believe that kings and queens reign because we allow him/her to reign over us and it’s nothing to do with God. So a modern audience would see the murder of Duncan as just a very serious murder, not a crime against God. This is also because we believe much less in religion now than we did 400 years ago. Plus, the monarch today does not have it much power as it did back then; since the English civil war, laws are passed by parliament, the king or queen virtually has no power and can be abolished by parliament at any time. When Macbeth sees the witches for the final time to show him the apparitions, again in thunder and rain, they cast a spell in rhymes in order to do that. For example one says, â€Å"By the pricking of my thumbs, something wicked this way comes†. Jacobeans would see this as the witches truly casting a spell but today we this as just a poem. Also, the apparitions that the witches come up with would have been seen to have really done that by a Jacobean audience, because again, they thought witches had unlimited magical powers and could do almost anything, including bringing out naked out of a bubbling pot children or futuristic visions out of their cauldron. A modern audience would see this as Macbeth being drugged by the witches and that potion made him go on to see those apparitions, perhaps in some sort of trans or dream. We don’t believe in witches having the magical power to do that themselves. The final thing whose perception has changed is Lady Macbeth sleepwalking. In Jacobean times, people did not understand that anyone can sleepwalk for whatever reason and thought anyone who did was mad meaning they thought Lady Macbeth was mad and stressed because of what her husband had just been doing. Today however, we think that anyone can sleepwalk and hence Lady Macbeth could have been feeling fine and she was doing a totally random thing. We no longer link sleepwalking with madness. So to conclude, in Jacobean times 400 years ago, people were less knowledgeable about science, weather and how the mind worked. This combined with poor education for most people then, meant that the Jacobeans had to make up phenomenon like witches and ghosts to explain why bad things happen or things go wrong. Nowadays, more people live in urban areas and are well-educated and less religious. Kings and queens have mostly been replaced by fully elected party leaders and the monarch is now just a person and far less important in decision making and politics. Doctors and psychology mean we can understand people’s emotions better and events such as bad weather are now explained by science.
